Candidate Terms of Use and Data Consent Form

This Candidate Terms of Use and Data Consent Form (‘Agreement’) is a legally binding contract between you and Hirely. It sets out the rules that apply when you register on, access, or use the Hirely mobile or web application (‘the Application’ or ‘the Platform’), which is operated by Hirely and developed by Granger Tech.
Please read this document carefully before you proceed. In plain terms, Hirely exists to connect job seekers like you with companies that are hiring (‘Clients’). To do that job well, we need two things from you - your accurate information about yourself, and your permission to share that information with the clients we introduce you to. This Agreement explains exactly what that means, what you're agreeing to, and what happens if things go wrong.
You will be treated as having read, understood, and accepted every term in this Agreement the moment you do any of the following:
- Create a candidate profile on the Platform;
- Upload a Curriculum Vitae (CV), resume, or any supporting document;
- Apply for a job, internship, contract, or secondment opportunity through Hirely; or
- Participate in any interview, assessment, or screening process facilitated by Hirely.
In this Agreement, ‘Candidate’, ‘Job Seeker’, and ‘You’ refer to the individual registering on or using the Platform for career-related purposes.
If you do not agree with any part of this Agreement, you should not register on, access, or continue to use the Platform.
Use of the Application and Account Registration
1.1. Eligibility and Purpose: The Application is made available to assist Job Seekers in finding and pursuing employment, contract, or secondment opportunities with Hirely's Clients. You confirm that you are using the Platform for genuine, lawful, personal, and professional career-search purposes only, and not for any fraudulent, commercial, or unrelated purpose.
You further confirm that you are legally permitted to work in the jurisdiction(s) for which you are applying, or, where you require a permit, visa, or other authorization to work, that you will disclose this to Hirely and any prospective Client at the earliest opportunity.
1.2. Account Creation and Security: When you register, you agree to provide accurate registration details and to keep them up to date. You are solely responsible for:
- Keeping your login credentials (username, password, and any authentication details) confidential;
- All activity that takes place under your account, whether you personally carried it out; and
- Notifying Hirely without delay and in any event within twenty-four (24) hours of discovery, if you suspect or become aware of any unauthorized access to your account, loss of your device, or other security breach.
Hirely will not be liable for any loss or damage arising from your failure to keep your account secure, except to the extent that the loss results from Hirely's own negligence or breach of its data protection obligations.
1.3. Availability of the Application: Hirely reserves the right, at its sole discretion, to modify, restrict, suspend, or discontinue access to the Platform or any feature of it, at any time and without prior notice, whether for scheduled maintenance, security reasons, upgrades, regulatory compliance, or general operational reasons. Hirely will make reasonable efforts to give advance notice of any planned suspension likely to significantly affect your use of the Platform but is not obliged to do so.
Accuracy of Information and Qualification Warranty
2.1. Duty of Truthfulness: You expressly represent and warrant to Hirely that all information you provide, including but not limited to your CV, employment history, academic qualifications, professional certifications, references, portfolio links, and identification documents is complete, accurate, current, and not misleading in any material respect.
This warranty is a condition of your continued use of the Platform and is relied upon by Hirely and by every Client to whom your profile is presented.
2.2. No Impersonation or Forgery: You must not:
- (a) Impersonate any other person or entity, or falsely claim an affiliation with any person, company, or institution;
- (b) Misstate or exaggerate your identity, qualifications, work experience, or credentials; or
- (c) Upload, submit, or rely on any forged, altered, or fraudulently obtained document (including certificates, reference letters, or identification).
2.3. Consequences of Misrepresentation: Providing false, misleading, incomplete, or deceptive information is treated as a material breach of this Agreement. Where Hirely reasonably believes such a breach has occurred, Hirely may, at its discretion and without prior notice:
- (a) Suspend or permanently deactivate your candidate profile;
- (b) Withdraw or rescind any job recommendation, introduction, or offer already extended on your behalf; and
- (c) Inform any Client to whom your profile was presented of the misrepresentation, where Hirely considers this necessary to protect the integrity of its service or the interests of the Client.
You acknowledge and accept that Hirely shall not be liable to you for any rejection, withdrawal of offer, disciplinary action, or termination of employment that results, directly or indirectly, from any inaccurate, false, or misleading information you provided. You agree to indemnify Hirely against any claim, loss, or liability arising from such misrepresentation to the extent permitted by Nigerian law.
Data Processing, Consent, and Client Presentation
This section explains what Hirely does with your personal data. Hirely takes its obligations under the Nigeria Data Protection Act 2023 (NDPA) and the regulations and guidance issued by the Nigeria Data Protection Commission (NDPC) seriously, and this section is intended to give you a clear, informed basis on which to give your consent.
3.1. What Data We Collect and Why: By creating a profile and uploading your CV and other personal information, you grant Hirely a non-exclusive, worldwide, royalty-free license to collect, store, process, format, translate, and analyze your candidate data, including your name, contact details, employment and education history, skills, assessment results, and any other information you submit, strictly for the purpose of recruitment, candidate-matching, and related administrative functions.
Hirely will not use your personal data for any purpose unrelated to recruitment (such as unrelated marketing by third parties) without obtaining your separate, specific consent.
3.2. Consent to Share Your Profile with Clients: You expressly authorize Hirely to share, present, and transmit your candidate profile, including your resume, contact details, assessment scores, and interview feedback, to prospective Clients and partner organizations, for the purpose of considering you for recruitment, secondment, or contract engagement opportunities.
You understand that once your profile is shared with a client, that Client becomes independently responsible, as a separate data controller, for how it handles your information, subject to applicable law and any data-sharing agreement between Hirely and that Client.
3.3. Reference and Background Checks: You authorize Hirely and its Clients to carry out reasonable and relevant reference checks, qualification verifications, and background screening, using the contact details and information you have provided. Where a background check requires information beyond what you have already submitted (for example, a criminal record check), Hirely or the relevant client will seek your separate, specific consent before proceeding, as required by law.
3.4. Your Rights Under the NDPA: As a data subject under the NDPA, you have the right to, among others:
- (a) Be informed about how your personal data is processed (which this section aims to do);
- (b) Request access to the personal data Hirely holds about you;
- (c) Request correction of inaccurate or incomplete data;
- (d) Request deletion of your data, subject to Hirely's lawful obligation to retain certain records (see Clause 6.1);
- (e) Withdraw your consent to processing at any time, without affecting the lawfulness of processing carried out before withdrawal; and
- (f) Lodging a complaint with the Nigeria Data Protection Commission if you believe your data has been mishandled.
You may exercise these rights by contacting Hirely through the support channels provided on the Platform. Hirely will retain and process your personal data only for as long as is reasonably necessary for the purposes described in this Agreement, or as required by applicable law.
3.5. Data Security: Hirely will take reasonable technical and organizational measures to protect your personal data against unauthorized access, loss, or misuse. However, no system can be guaranteed completely secure, and you acknowledge that you provide your information at your own risk, without prejudice to Hirely's obligations under the NDPA.
Nature of the Relationship Between You and Hirely
4.1. No Employment Relationship with Hirely: Your registration on the Platform, and the presentation of your profile to a client, does not create an employer-employee relationship, partnership, joint venture, or agency relationship between you and Hirely. Hirely acts solely as an intermediary technology platform that facilitates introductions between Job Seekers and Clients.
4.2. No Guarantee of Placement: Registering on Hirely, uploading a CV, or applying for a job by, does not guarantee that you will receive an interview, a job offers, or any form of engagement. All hiring decisions, including the terms of any offer, rest entirely with the relevant Client, and Hirely has no control over, and accepts no liability for, those decisions.
Candidate Conduct
5.1. Professional Conduct: You agree to conduct yourself professionally, honestly, and courteously in all interviews, assessments, and communications carried out through or facilitated by Hirely, whether with Hirely staff or with a client.
5.2. Direct Contact by Clients: If a client that Hirely introduced you to contacts you directly outside the Platform, for instance, by personal email, phone, or social media, regarding an application or role that originated through Hirely, you agree to notify Hirely within forty-eight (48) hours of that contact. This helps Hirely keep track of your application status and avoid confusion or duplicated effort on your behalf.
Deactivation and Suspension of Your Profile
6.1. Deactivation by You: You may request the deactivation or deletion of your Hirely account at any time, either through your account settings or by contacting Hirely support. Hirely will act on such a request promptly, subject to its right to retain certain records where required for legal, regulatory, audit, or dispute-resolution purposes, in line with the NDPA and other applicable law.
6.2. Suspension by Hirely: Hirely may suspend or remove your profile, without prior notice, where you breach this Agreement, engage in fraudulent or dishonest conduct, or behave unprofessionally or abusively toward a client or a Hirely representative.
Limitation of Liability
To the fullest extent permitted by Nigerian law, Hirely shall not be liable for any indirect, incidental, or consequential loss arising from your use of the Platform, including loss of a job opportunity, loss of income, or reputational harm, except where such loss arises directly from Hirely's own negligence, willful misconduct, or breach of its obligations under this Agreement or the NDPA.
Governing Law and Dispute Resolution
This Agreement is governed by, and shall be interpreted in accordance with, the laws of the Federal Republic of Nigeria. Any dispute arising from or relating to this Agreement shall, in the first instance, be referred to good-faith discussions between you and Hirely, and if unresolved, may be submitted to the courts of Nigeria having jurisdiction, or to arbitration if the parties so agree.
Candidate Acknowledgment and Consent
By clicking ‘I Agree,’ checking the consent box, or uploading your resume on the Hirely platform, you confirm that:
- You have read, understood, and freely agree to be bound by the terms of this Agreement;
- All information contained in your CV and other application materials is true, accurate, and complete to the best of your knowledge; and
- You give your informed consent to Hirely processing your personal data and sharing your profile with prospective employers and recruitment partners, as described in Clause 3 above.
